1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and LukyLab s.r.o. ("LukyLab," "we," "us," or "our") regarding your use of the PromptKit application for iOS and the website located at promptkit.app (collectively, the "Service").
By downloading, accessing, or using PromptKit, you agree to be bound by these Terms and by Apple's Standard Licensed Application End User License Agreement (EULA). If you do not agree to these Terms, do not use the Service.
2. License and Intellectual Property
Subject to your compliance with these Terms, LukyLab grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use PromptKit on iOS devices that you own or control, strictly in accordance with Apple Media Services Terms and Conditions.
The App, including its original content, features, templates, design, and branding, is and will remain the exclusive property of LukyLab s.r.o. and its licensors. Prompts created personally by you remain your intellectual property.
3. Purchases, Subscriptions, and Promo Codes
a. Free Tier & In-App Purchases
PromptKit offers a free tier with access to core prompt features and templates. Optional premium features ("PromptKit Pro") are available through in-app purchases or subscriptions billed through your Apple ID account.
b. Renewals and Cancellations
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your Apple ID Account Settings.
c. Promotional Offers & Promo Codes
Promotional codes (such as offer code BOOSTAI) are subject to availability, eligibility criteria determined by Apple, and may be redeemed directly in the App Store pursuant to Apple's Offer Code redemption guidelines.
d. Refunds
All transactions and refund requests are processed directly by Apple according to Apple App Store policies. To request a refund, please visit reportaproblem.apple.com.
4. Acceptable Use and Third-Party AI Services
You agree not to use PromptKit to generate, store, or distribute content that is illegal, harmful, threatening, abusive, or violating third-party rights.
PromptKit is a prompt management and optimization utility. We do not operate third-party LLMs (such as ChatGPT, Claude, Gemini, or Midjourney) and are not responsible for outputs, availability, or policies of those independent AI platforms.
5. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
6. Limitation of Liability
To the maximum extent permitted by applicable law, LukyLab s.r.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data arising out of or related to your use of the Service.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.
